You (herein referred to as the “Customer”) can subscribe to Simara’s (herein referred to as the “Company”) 11+1 Annual Plan by selecting a fixed monthly installment amount. Minimum installment amount per month is INR 5000/= (Indian Rupees Five Thousand Only) and the 12th installment will be borne by the Company.
The Customer must be 18 years or above.
PAYMENT AND REDEMPTION:
The monthly installment amount needs to be paid on or before the monthly due date. Payments can be made at the Company’s store or online.
Payment due date: On or before the 5th of every month.
Payment Method: Payments can be made at the Company’s store or via online methods.
Statement: The Company will provide a digital statement to record all payments made by the Customer.
Under the plan, the Customer will be entitled to purchase any Natural Diamond Jewellery from the Company.
If the price of the chosen jewellery exceeds the total redeemable value, the Customer shall pay the difference amount.
If the price of the chosen jewellery is less than the total redeemable value, the balance amount will not be refunded and can only be redeemed against the purchase of additional Natural Diamond Jewellery.
The plan cannot be availed and/ or combined with any other offers/ discounts/ sales/ promotions etc., that may be offered by the Company.
The installment amount paid by the Customer to the Company is interest-free.
The redemption value is exclusive of applicable Goods and Services Tax (GST) or other government levies, which shall be borne by the Customer at the time of purchase.
In the event, the Customer is rendered incapable of continuing under the plan, the nominee specified at the time of subscription, or in the absence of a nominee, the legal heir(s) (upon providing requisite legal documentation), shall have the right to continue the membership under the existing plan or opt for pre-mature termination and redeem the total amount paid by the Customer as credit towards the purchase of Natural Diamond Jewellery, as per the Pre-Mature Termination clause below within a period of 1 (one) year from the event of such incapability.
In the event where no nominee, or legal heir claims under the plan within a period of 1 (one) year as specified above, the plan shall stand terminated and any installment that is already made shall be considered to have been forfeited by the Customer.
PRE-MATURE TERMINATION:
The Customer may choose to terminate the plan before the 12-month period is complete.
In the event of pre-mature termination, the Customer will not be eligible for the Company’s 12th month installment benefit.
The total amount paid by the Customer is non – refundable and can only be redeemed as credit towards purchase of Natural Diamond Jewellery from the Company.
In the event, the Company discontinues the plan, the Customer may redeem the amount against purchase of any Natural Diamond Jewellery from the Company within a period of 6 months from the date of discontinuation.
MISCELLANEOUS
Under any circumstances, the installment paid is non – refundable and can only be redeemed towards the purchase of natural diamond jewellery from the Company.
The plan does not protect against changes in the price of natural diamonds or the market rate of gold and precious metals. The final price will be the prevailing price on the date of redemption.
Any disputes arising out of or in connection with the plan shall be subject to the exclusive jurisdiction of the courts of Mumbai.
In the event of breach of any of the T&Cs, the Company reserves the right to cancel the subscription.
The Company reserves the right to amend all the T&Cs above without prejudice to installments already made.
